Until that document is published, your use of Construction Cloud is governed by the agreement between Construction Cloud and your tenant organisation.
Acceptance
By accessing or using Construction Cloud ("the Service"), you agree to these Terms of Use. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these terms.
The Service
Construction Cloud is a multi-tenant business-to-business software platform that helps UK housebuilders, main contractors, and subcontractors manage construction snags, defects, and aftercare work. The Service is provided via web browser and via the iOS mobile application.
Subscriptions and billing
Access to the Service requires an active subscription held by a tenant organisation. Subscription terms, pricing, and billing frequency are set out in the order form or commercial agreement between Construction Cloud and the tenant organisation.
Customer data and ownership
You retain ownership of all data your organisation submits to the Service. We process that data on your behalf in accordance with our Privacy Policy.
Acceptable use
You agree not to use the Service in a way that violates applicable law, infringes third-party rights, or attempts to disrupt the security or integrity of the Service.
Intellectual property
Construction Cloud retains all intellectual property rights in the Service software, design, and brand. Your subscription grants a limited right to use the Service; it does not transfer ownership of the underlying platform.
Limitation of liability
To the fullest extent permitted by law, Construction Cloud's aggregate liability arising from or in connection with the Service is limited as set out in the commercial agreement with your tenant organisation.
Termination
Either party may terminate use of the Service in accordance with the commercial agreement. Upon termination, access to the Service ends and customer data export is handled per our standard off-boarding process.
Governing law
These Terms of Use are governed by the laws of England and Wales. Disputes arising from the Service are subject to the exclusive jurisdiction of the courts of England and Wales.
Changes to these terms
We may update these Terms of Use from time to time. Material changes will be communicated to tenant administrators in advance of taking effect.
